Terms & Conditions

These Terms and Conditions, together with our and any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with AGS Golf Vacations Limited.

Deposits and Full Payment

A deposit of 25 - 40% of the quoted price per person is normally required to secure a booking. Any variation necessary, such as hotel contracts for group bookings, will be explained in writing. Visa, Mastercard, American Express or bank transfer are accepted. The balance of payment is normally required 90 days before commencement of the tour. Any Special package with earlier requirements will be notified in writing. 

Confirmation

Upon receipt of your booking and deposit, a confirmation will be issued and sent to you or your agent. When the confirmation is received a contract is made. Upon receipt, if you believe that any details on your booking confirmation or any other document are incorrect you must inform us within 7 days to make the corrections.
Only items in the confirmation are included in the price, other items such as caddies, alcoholic drinks, laundry, telephone, meals not specified are not included.
Changes can be applied at any time - subject to availabilities and the price will change accordingly.

Jurisdiction and Applicable Law

These Terms and Conditions and any agreement to which they apply are governed in all respects by English law. We both agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of England and Wales only. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you live in those places and if you wish to do so. 

Cutting your holiday short 
If you are forced to return home early, we cannot refund the cost of any travel arrangements you have not used. Depending on the circumstances, your travel insurance may offer cover for curtailment and we suggest that any claims is made directly with them. 

Confidentiality

AGS Golf will treat all personal data received from clients in strict confidence and in accordance with our Privacy Policy.

Car Rental

Drivers must be 21 years of age and have a valid driver’s license. Please advise us and/or the car rental company of the age of any proposed driver over 70 years. Car rental rates do not include gas, additional drivers or personal accident insurance. Car rental companies or tour operators are not obligated to make refunds on unused services.

Notice

It is unlikely that we will have to make any changes to your holiday once accommodation, golf and any transport have been pre-booked. If any change from the original itinerary becomes necessary due to circumstances outside of our control you will be advised promptly and provided with alternative services of equal or greater value.

Transfer of booking

If you or any member of your party is prevented from travelling, that person(s) may transfer their place to someone else, subject to the transferee agreeing to these booking conditions and all other terms of the contract between us. You must inform of us of no less than 14 days before departure. You and the transferee remain jointly and severally liable for payment of all sums. If you are unable to find a replacement, cancellation charges as set out in clause 9 will apply.

Cancellation

You or any other member of your party may cancel your booking. Any cancellation must be in writing and will take effect when it is received in writing. The cancellation will be effective from the date it is received by us. Cancellation charges apply as per below:
More than 90 days prior to arrival – Full deposit is non-refundable. AGS Golf do not hold the deposit its used to secure booking with suppliers. In most cases we can move the trip with full credit to another date or seek to find a replacement person or group.

90-30 days prior to arrival - Full deposit plus non-refundable Hotel, Golf, Transport and Credit Card charges.
Less than 30 days prior to arrival - no refund will be payable on cancellation.

Cancellation due to Unavoidable and Extraordinary Circumstances
Please note that your right to cancel in these circumstances will only apply where the Foreign and Commonwealth Office advises against travel to your destination or its immediate vicinity. For the purposes of this clause, “unavoidable and extraordinary circumstances” means warfare, acts of terrorism, and significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination. If you are forced to cancel due to the reasons stated above, we will offer you a credit for a future booking.
This clause 9 outlines the rights you have if you wish to cancel your booking. Please note that there is no automatic statutory right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Directive 2011/83/EU). 

Events beyond our Control
Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Events Beyond our Control”. For the purposes of these Booking Conditions, Events Beyond our Control means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’ s control. 

Insurance
Adequate travel insurance is a condition of your contract with us. You must be satisfied that your insurance fully covers you pre-existing medical conditions, personal accident, injury or illness, loss or damage of luggage and forced cancellation and repatriation in the event of accident or illness. If you choose to travel without adequate insurance cover, we will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available. 

Passports
All US and Canadian citizens are required to be in possession of a current passport. It is your responsibility to check and fulfil the passport, visa, health and immigration requirements applicable to your itinerary. We can only provide general information about this and you must check the requirements for your own specific circumstances. We do not accept any responsibility if you cannot travel, or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities. 

Responsibility
AGS Golf as the Destination Management Company, acts only as an agent in securing and booking land tours services for hotel accommodation, golf tee-times, tour guides and transport, all from independent contractors who are not subject to the management control of the Destination Management Company. AGS Golf accept no liability for injury, loss, damage, accident, delay or inconvenience caused by any defect in the operation of any vehicle or conveyance or caused by the act or omission, neglect delay or default of any person engaged in transporting tour participants or in providing hotel accommodations or other tour services or caused by any event which is beyond the reasonable control of AGS Golf.

Excursions 
Excursions or tours that you may choose to book or pay for whilst you are on holiday are not part of your contracted arrangements with us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

Final Documents
Final Documents will normally be issued 4 weeks prior to your start date and will be a comprehensive pack of information and vouchers suitable for an outstanding tour. Each party member is obliged to send the requested information up to 6 weeks prior to arrival.

STANDARD INFORMATION FORM FOR PACKAGE TRAVEL CONTRACTS

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302.

Therefore, you will benefit from all EU rights applying to packages. Company AGS GOLF Vacations Ltd Sp. z o.o. registered in Przybiernów (National Court Number: 0001075818) will be fully responsible for the proper performance of the package as a whole.

Additionally, as required by law, company Company AGS GOLF Vacations Ltd Sp. z o.o. registered in Przybiernów (National Court Number: 0001075818) has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes/they become insolvent.

Key rights under Directive (EU) 2015/2302:

  • Travellers will receive all essential information about the package before concluding the package travel contract.
  • There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
  • Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the travel agent
  • Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
  • The price of the package may only be increased if specific costs rise (for instance fuel prices), and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8 % of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.
  • Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate.
  • Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
  • Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
  • If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
  • Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
  • The organiser has to provide assistance if the traveller is in difficulty.
  • If the organiser or, in some Member States, the retailer becomes insolvent, payments will be refunded. If the organiser or, where applicable, the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured. Company AGS GOLF Vacations Ltd Sp. z o.o. registered in Przybiernów (National Court Number: 0001075818) has taken out insolvency protection with Signal Iduna Polska Towarzystwo Ubezpieczeń S.A. (the entity in charge of the insolvency protection, e.g. a guarantee fund or an insurance company). Travellers may contact this entity or, where applicable, the competent authority (adres e-mail: info@signal-iduna.pl, tel. tel. /0-22/ 50-56-508) if services are denied because of Signal Iduna Polska Towarzystwo Ubezpieczeń S.A. 's insolvency.
